Wedding Photography Agreement
This agreement is entered into between Matthew Paul Photo ("Photographer") and the client(s) who submit the form below ("Client"), and outlines the terms for wedding photography services. By completing and submitting the form at the bottom of this page, both signing parties agree to the terms below in full.
1. Package & Coverage. The package, coverage hours, and any add-ons are selected in the form below and become part of this agreement once submitted. If Client has not yet selected a final package at the time of signing, this agreement reserves the wedding date upon receipt of the retainer. Client agrees to confirm final package, coverage hours, and pricing no later than 60 days prior to the wedding date. The remaining balance will be calculated based on the final package selected at that time.
2. Wedding Day Timing. Exact wedding-day timing will be confirmed via a separate Wedding Day Questionnaire sent closer to the date. Any times listed in this agreement or the form below are estimates only and do not limit or define Photographer's contracted coverage hours.
3. Fees & Payment. A non-refundable retainer of $1,000 is due to reserve the Client's date. The date is not considered booked until the retainer and this signed agreement are received. This retainer amount is the same regardless of final package selected and will be credited toward the total once a package is confirmed. The remaining balance is due in full by the date confirmed at booking; the wedding date will not be shot without payment in full. Additional hours worked beyond contracted coverage on the wedding day are billed at the agreed overtime rate and due within 14 days of the wedding.
4. Cancellation & Rescheduling. If the Client cancels, the retainer is non-refundable under any circumstances. If the Client needs to reschedule, Photographer will make a reasonable effort to accommodate a new date, subject to availability; the retainer transfers to the new date if given at least 60 days' notice. If Photographer becomes unable to perform due to illness, emergency, or other circumstance beyond their control, Photographer will make every effort to secure a qualified replacement of similar style and skill. If no replacement can be secured, Photographer will refund all payments received.
5. Copyright & Usage Rights. Photographer retains full copyright and ownership of all images. Client is granted a personal-use license to print, share, and display delivered images for personal, non-commercial purposes. Photographer retains the right to use images for portfolio, marketing, website, and social media unless the Client opts out in the form below.
6. Delivery. A sneak-peek gallery is typically delivered within 48-72 hours of the wedding. The full edited gallery is delivered digitally within the timeframe confirmed at booking.
7. Model Release. Client grants Photographer permission to photograph the wedding day and all guests, vendors, and venues present, and consents to the use of these images as outlined above.
8. Liability. Photographer will exercise reasonable care with all equipment and data. In the unlikely event of equipment failure, memory card corruption, or accidental loss beyond Photographer's control, Photographer's liability is limited to a full refund of monies paid. Photographer is not liable for missed shots due to circumstances outside their control, including uncooperative subjects, schedule changes, venue restrictions, or interference by other photographers or guests.
9. Force Majeure. Neither party is responsible for failure to perform due to causes beyond reasonable control (acts of God, natural disaster, extreme weather, government restriction, etc.). Both parties will work together in good faith to reschedule.
10. Wedding Day Conduct. Client agrees to provide a reasonable meal break for Photographer(s) during coverage spanning a meal service, and that other photographers won't interfere with Photographer's ability to capture key moments.
11. Governing Law. This agreement is governed by the laws of the State of North Carolina.
12. Entire Agreement. This document, together with the submitted form, is the entire agreement between both parties and supersedes any prior discussion, written or verbal. Changes must be made in writing and agreed by both parties.
